Which possibilities are there for Africans to migrate legally to Europe?
There are certain qualifications that have to be fulfilled to legalize the abode of fugitives through a visa.
· First of all, they have to exhibit that their means of subsistence are ensured.
· The identity and nationality have to be made clear.
· There should not be a reason for deportation.
· The interest of the Federal Republic of Germany should not be endangered or affected.
· The obligation to carry a passport has to be fulfilled referring to §3.
Are there gaps in the law that intensify the problem of illegal immigration?
There is a certain gap in the law that makes it impossible for Spain to get rid of fugitives.
The only chance to expel them from the EU is taking them into custody for no more than 40 days so that they can be deported after that. If it was the case that the responsible government does not know where to deport the fugitives, they have to be released. Though, it is possible for them to go underground and hide from which country they come from.
How does the EU try to better control the Immigration concerning Africans into European countries?
There are several political measures trying to regulate illegal immigration:
· Enforcement of the EU- external Community borders: The European Commission proposes to register non- European citizens with aid of biometric data when entering or leaving the EU. This would be a chance to have the control about those who kept staying in the EU illegally.
· Through this it is aimed for fighting against slave trade
· As well as clandestine employment: The fact is, that much work is carried out by illegal immigrants that are mostly preyed (ausgebeutet) for example at construction sites (Baustellen) or catering trades. It should be moved in on the problem that the chance of getting employed represents a significant attraction for illegal immigration. Through this there should also not be this attraction for employers anymore to hire illegal immigrants. In order to this, the measures against those employers will be harmonized.
· Finally the EU is attempted to continue the effective way of leading immigrants back to their origin country.
